FINDINGS AND RULING OF REFEREE AND DECREE OF THE WATER COURT

IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF THE
COLORADO WATER CONSERVATION BOARD ON BEHALF OF THE
PEOPLE OF THE STATE OF COLORADO,

IN CUB CREEK, A NATURAL STREAM,

IN THE WATERSHED OF THE SOUTH PLATTE RIVER,

IN JEFFERSON COUNTY, COLORADO.

This Application was filed on December 27, 1994, and was referred to the Water Referee
for Water Division No.1, in accordance with C.R.S. S9 37-92-101, et seq. All notices required
by law of the filing of this Application have been fulfilled and the Referee has jurisdiction of this
Application. Timely Statements of Opposition were filed by Buffalo Park Development
Company, Colorado Mountain Properties, Inc. and Evergreen Memorial Park Inc. On May 5,
1995, the Division Engineer submitted a Summary of Consultation. On January 31, 2000, an
Order of Rereferral was entered in this matter.
