STIPULATION

IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF THE
COLORADO WATER CONSERVATION BOARD,

IN BEAR CREEK, A NATURAL STREAM,

IN THE WATERSHED OF BEAR CREEK,

IN JEFFERSON COUNTY, COLORADO.

The Applicant, Colorado Water Conservation Board ("CWCB"), and Objector Genesee
Water and Sanitation District ("Genesee"), by and through their undersigned attorneys, stipulate
and agree as follows:

I. Genesee agrees to the entry of a decree in this case that is no less restrictive than
the decree attached to this stipulation and marked as Exhibit A.

2. The CWCB acknowledges that Genesee has senior decreed wa.ter storage rights, as
decreed in Case Nos. W-7049, W-7050, and 94CWl50, to store up to 125 acre-feet per year of
Pioneer Union Priorities 5, II, and 15 in any and all of the following storage reservoirs:

a. Evergreen Reservoir: Located in the SY2 NWY4, NY2 SWY4, SWY4 NEY4 and NWY4 SEY4 of
Section 10, Township 5 South, Range 71 West, 6th P.M.

b. Hiwan Reservoir No. I: The reservoir outlet is located at a point whence the NE comer of
Section 29, Township 4 South, Range 71 West, 6th P.M. bears North 67000' East, 750 feet.

c. Hiwan Reservoir No.4: The high water line of the left abutment of the dam is located at a point
whence the E quarter comer of Section 24, Township 4 South, Range 71 West, 6th P.M. bears north
OOOO'East, 715 feet.
