1. 19,875 acre-feet per year may be diverted by Colorado for transmountain users. <br />Transmountain users include Water Supply and Storage Company (Laramie <br />Poudre Tunnel Diversion and Skyline Ditch), The Tunnel Water Company <br />(Laramie Poudre Tunnel Diversion and S kyline Ditch), The Divide Canal and <br />Reservoir Company (Wilson Supply Ditch a nd Deadman Ditch), and the City of <br />Greeley (Bob Creek Ditch and Columbine Ditch). Each of these diversions <br />exports water from the Laramie Ri ver basin into Water District 3. <br />2. 29,500 acre-feet per year may be diverted by Colorado irrigators (called the <br />“meadow users”) for use within the basin (W ater District 48), of which not more <br />st <br />than 1,800 acre-feet can be diverted after July 31 of each year. <br />3. Any portion of the 19,875 acre-feet per ye ar not diverted by Colorado for use <br />outside the basin can be added to the 29,500 acre-feet per year permitted for use <br />within the basin. <br />4. All waters diverted by Colorado for use with in the basin are rest ricted to irrigation <br />use on the 4,845 acres designated by the court at the time of the decree. <br />The Sand Creek Memorandum Agreement applies to waters diverted from Sand Creek. <br />Wilson Supply Ditch is the only transmountain diversion structure in cluded in the Sand <br />Creek Memorandum Agreement. The origin al Sand Creek Memorandum of Agreement <br />was filed March 13, 1939. On August 17, 1997 the Agreement was revised to reflect <br />actual agreement administration. The Sand Cr eek Agreement allocates waters of Sand <br />Creek between Wyoming and Colorado in accord ance with the priority water rights in <br />each state as follows: <br />1. At the start of each irrigation season, Wyoming shall give notice to Colorado <br />when Wyoming’s demand reaches 40 cfs. At that time, Colorado will deliver up <br />to 40 cfs, of that available after Colo rado’s pre-June 15, 1999 water rights, listed <br />in the agreement, are satisfied. <br />2. Colorado will deliver 40 cfs to the state line gage for a period of seven days (need <br />not be consecutive), then will deliver 35 cfs when Wyoming senior appropriators, <br />listed in the agreement, request. <br />OPERATIONAL INFORMATION <br />Wilson Supply Ditch usually begins diverting in early-May. The peak disc harge occurs in late- <br />May or early June and the flow tapers off to zero by August. <br />Divide Reservoir and Canal Company diverts Wi lson Supply Ditch water, stores the water in <br />Worster Reservoir or Hallagan Reservoir, and re leases the water on an as needed basis through <br />the North Fork of the Cache la Poudre River for irrigation and municipal use. <br />Where to find more information <br />Specifics relating to the data collection and f illing processes used in the determination of <br />the best source of data are presented in the SPDSS Task 4 Memorandum – Identify and <br />Fill/Resolve Conflicting R ecords for Key Transmountain Diversion Structures. <br />WilsonSupplyDitch.doc 6 of 8 <br />
