The City had an exchange decree recently adjudicated for the majority of its water rights
ownership in Union Reservoir up to its upper basin reservoirs and to provide for the storage or
diversion, by exchange, of it transbasin water, changed water, stored water, and reusable
supplies, including effluent from its use of changed ditch shares (early transfers and later
transfers) and Windy Gap supplies. The decree in Case No. 86CW395 (aka Union Reservoir
exchange) was adjudicated on December 10, 2003 and provides for the exchange of water, as
summarized in Table 6. The City has not operated any of these exchanges but will likely start
operation of some or all of these exchanges in the near future.
Table 6
Exchange Rights
From- and To-Points Approp. As such, water made available
through the C-BT Project is used within the City's service area. The City began deliveries
associated with its original ownership of 5,000 C-BT units in 1952. The C-BT ownership has
increased over time to a current holding of 12,200 units, mainly as a consequence of raw water
dedications. Longmont was one of the original entities involved in the Windy Gap project and
has ownership of 80 of the 480 total Windy Gap units.
Pending Water Rights Cases
The City has a number of cases pending in the Water Division 1 water court that will provide for
year-round recreational water rights along the St. Vrain Creek at the eastern edge of town and
City of Longmont Operating Memorandum.doc Page 14 of 21 March 2, 2005
