An additiona120.5 cfs remains conditional. <br />Table 4 shows rights originally decreed for irrigation uses that have been changed by the City to <br />allow municipal use and alternate points of diversion. Shown in Table 4 are only the irrigation <br />rights that have been changed in Water Court by the City, i.e., the City owns additional irrigation <br />rights that have not been changed. City ownership in several ditches has changed overtime. The <br />City did not provide a complete list of its water rights holdings in ditch companies nor the <br />historical development of its water right portfolio. <br />It is important to note that a portion the City's ownership in several irrigation ditches may be used <br />for instream flow purposes. In Case No. 90CW 193, the City conveyed to the Colorado Water <br />Conservation Board water associated with a portion of their ownership in the Farmers, Anderson, <br />Smith-Goss, Harden and McCarty Ditches. This water may be used to supplement flows in <br />Boulder Creek during low flow periods. However, the City maintained the ability to use the <br />rights, if necessary, to meet municipal demand in a drought or emergency or when the water is not <br />needed for instream flow. The City also reserved the right to lease the historically consumed <br />portion of the "instream flow water" to downstream users after it has passed through the City. <br />In Case No. 94CW285, the City changed a portion of its ownership in the North Boulder Farmers <br />Ditch to municipal uses and to allow diversion of these rights at its upper intake points on North <br />and Middle Boulder Creeks or for irrigation of lands below the North Boulder Farmers Ditch. The <br />changed water rights have diversion rate and monthly, annual and 10-year cumulative volumetric <br />limits. There are return flow obligations associated with the City's use of these rights which are <br />determined based on the amount of use. In addition, the City was awarded rights of substitution <br />and exchange whereby reusable municipal return flows from the North Boulder Farmers Ditch <br />rights that are available at the City's wastewater treatment plant outfall (up to 5.2 cfs) are left in <br />Boulder Creek to supply downstream appropriators and an equivalent amount of water is diverted <br />from North and/or Middle Boulder Creek. <br />City of Boulder Memo.Doc Page 17 of 30 March 9, 2005 <br />
