02/04/2008 House Second Readin g Special Order - Lost with Amendments <br /> <br /> <br />BILL HB08 - 1099 <br /> <br /> <br /> <br />CONCERNING MODIFICATIONS TO ENVIRONMENTAL CONTROL PROVISIONS, <br />AND, IN CONNECTION THEREWITH, AUTHO RIZING THE WATER QUALITY <br />CONTROL COMMISSION, INSTEAD OF THE STATE BOARD OF HEALTH, TO HEAR <br />DRINKING WATER PENALTY APPEALS; MODIFYING THE PROCEDURES FOR <br />WATER DISCHARGE PERMIT APPLICATIONS; AND AUTHORIZING THE SOLID AND <br />HAZARDOUS WASTE COMMISSION, INSTEAD O F THE STATE BOARD OF HEALTH, <br />TO ADOPT RULES REGARDING, AND SET THE BOND AMOUNT FOR, WASTE TIRE <br />HAULERS. <br /> <br />Short Title: <br /> Cleanup Envtl Control Water Solid Waste <br />Sponsors: <br /> MCNULTY / TOCHTROP <br /> <br />Authorizes the water quality control commission, rather than the sta te board of health, to hear <br />appeals of penalties imposed for violations of minimum general sanitary standards and <br />regulations for drinking water. Eliminates the requirement that the division of administration <br />(division) in the department of public health a nd environment notify a water discharge permit <br />applicant within 45 days after receipt of the application that the application is incomplete. <br />Allows the division to request additional information when it deems an application is incomplete, <br />and requires the division to determine whether the additional information submitted by the <br />applicant satisfies the request within 15 days after receipt of the additional information. Allows <br />the division to provide public notice of a water discharge permit application and i ts preliminary <br />analysis thereof on the department's web site and extends the deadline for the division to hold a <br />public meeting on a permit application and on the division's analysis from 60 to 75 days after <br />public notice of the application and analysis is provided. Changes the time by which the division <br />must give notice of a public meeting on a water discharge permit application from 15 days prior <br />to the meeting date to 30 days prior to the meeting date. Extends to 45 days the deadline for a <br />division deter mination on a permit application when a public hearing is held.
