CONCERNING MODIFICATIONS TO ENVIRONMENTAL CONTROL PROVISIONS,
AND, IN CONNECTION THEREWITH, AUTHO RIZING THE WATER QUALITY
CONTROL COMMISSION, INSTEAD OF THE STATE BOARD OF HEALTH, TO HEAR
DRINKING WATER PENALTY APPEALS; MODIFYING THE PROCEDURES FOR
WATER DISCHARGE PERMIT APPLICATIONS; AND AUTHORIZING THE SOLID AND
HAZARDOUS WASTE COMMISSION, INSTEAD O F THE STATE BOARD OF HEALTH,
TO ADOPT RULES REGARDING, AND SET THE BOND AMOUNT FOR, WASTE TIRE
HAULERS.

Short Title:
Cleanup Envtl Control Water Solid Waste

Authorizes the water quality control commission, rather than the sta te board of health, to hear
appeals of penalties imposed for violations of minimum general sanitary standards and
regulations for drinking water. Eliminates the requirement that the division of administration
(division) in the department of public health a nd environment notify a water discharge permit
applicant within 45 days after receipt of the application that the application is incomplete.
Allows the division to request additional information when it deems an application is incomplete,
and requires the division to determine whether the additional information submitted by the
applicant satisfies the request within 15 days after receipt of the additional information. Allows
the division to provide public notice of a water discharge permit application and i ts preliminary
analysis thereof on the department's web site and extends the deadline for the division to hold a
public meeting on a permit application and on the division's analysis from 60 to 75 days after
public notice of the application and analysis is provided. Changes the time by which the division
must give notice of a public meeting on a water discharge permit application from 15 days prior
to the meeting date to 30 days prior to the meeting date. Extends to 45 days the deadline for a
division deter mination on a permit application when a public hearing is held. Authorizes the
solid and hazardous waste commission, rather than the state board of health, to adopt rules
pertaining to, and set the bond amount required to be posted by, waste tire haulers.
