To the extent that conflicts are found, Task 2 will include attempts to resolve these conflicts <br />by revising the recommendations, finding ways to accomplish the goals and objectives through other <br />means, or by eliminating the recommendations from further consideration. RWAPA and Roaring Fork <br />Conservancy Staff will be responsible for this task with the assistance of the Teclmucal Committee and <br />other agencies and consultants as needed. <br />Task 3 <br />Prioritized recommendations for local governments <br />Tlus Task will consist of the development of recommended actions specifically tailored for local <br />governments. The recommended actions will take into account local governments' authority and <br />statutory responsibilities, cost, coordination with other agencies and existing regulations and laws. The <br />recommended actions will include provisions that: 1) ensure protection of property and water rights and <br />2) maintain the yield of existing and future water rights and projects (except to the extent that those <br />existing rights and projects aught be modified by agreement among the parties affected) and 3) disclose <br />the potential impacts of recommended actions on future projects identified by stakeholders. Local <br />govermment in this case refers to City, Town and County governments. This task will be undertaken by <br />RWAPA and Roaring Fork Conservancy staff with the assistance of the Technical Committee. Local <br />government representatives and in-basin and out-of--basin stakeholders and water rights owners, will also <br />be asked to comment and help refine these recommendations. Recommendations will be developed <br />through a collaborative, consensus-based process aimed at producing recommendations which are <br />supported by all the parties involved and which are consistent with existing policies and procedures. It is <br />vital to the project that the recommendations of the Plan provide useful guidance to local governments <br />and that they not impose on local governments unenforceable or burdensome regulations. The challenge <br />associated with this task will be to develop recommendations that do not dinunish or impair water rights <br />and project yields (i.e., conform with 37-75-102) and which are useful in terms of their benefits to local <br />water resources while not imposing costs or policies which make them unadoptable or unenforceable. A <br />consensus-based process which involves local government officials will be the best approach to meeting <br />this challenge. The product of this Task element will be a list of recommended actions for each <br />jurisdiction within the watershed, prioritized according to their effectiveness in addressing consumptive <br />and non-consumptive needs. All recommendations will be developed in consideration of existing laws <br />and regulations to avoid conflict. All recommendations will include a disclosure statement which verifies <br />that the recommendation does not contradict, undermine, or supercede existing law. Please note that <br />these will be recommendations only and will have no force or effect until they are adopted and <br />implemented by an appropriate authority. <br />Task 4 <br />Prioritized recommendations for other water management agencies and individuals <br />Many other public and private agencies have some degree of authority over local water resources, <br />ranging from ditch companies to water and sanitation districts to the Colorado State Government to <br />Federal agencies such as the Forest Service and the Bureau of Reclamation. Tlus Task will consist of the <br />development of prioritized consensus based recommendations, developed in consultation with <br />stakeholders, especially water rights holders, to be submitted to these agencies in consideration of their <br />various areas of responsibility. h~ addition, recommendations will be crafted for individuals to apply to <br />their own use of water as a water rights holder or consumer. All recommendations will be developed in <br />consideration of existing laws and regulations to avoid conflict. All recommendations will include a <br />disclosure statement which verifies that the recommendation does not contradict, undermine, or <br />supercede existing law. These recommendations will be developed with the assistance of the Teclmlical <br />Committee, stakeholders especially water rights holders, water management agency staff, and the public <br />at large.
