I write to respond more completely to the ques~ons regarding the .referenced matter <br />you posed during .our recent'tclephone conversations.. First. you. inquired whether the <br />Mutual Mesa ditch is ~ "lateral'" off of one of. the Orchar.d Mc:s~ Irrigatic:>n Pistrict's <br />(OMID) main canals,' or is..administered by.OMID as one.ofiLt; main canals.. Jim Rooks, <br />Manager of OMID, informs me' that the Mutual Mesa ditch splits .off (rom OMID's Canal <br />No.1, and carries approximately 28 c.f.s of water to serve approximately 2,400 of <br />OMID's water users. OMID administers the Mutual Mesa ditch in the same manner as it <br />administers its Canal Nos. 1 and 2, and considers it to be one of its main delivery canals. <br />We have not independently verified the matters discussed in this paragraph, but.have relied <br />on. the statements of -OMID representatives. <br /> <br />, You also requested a copy of the signed resolution authorizing OMID to request and <br />obtain a loan from the Colorado 'Water Coriservation Bo~d for lining a portion of the <br />Mutual Mesa ditch. I enclose a copy of the ballot form distributed to the lalm owners at <br />OMID's 1996 annual meeting, as well as a copy of the minutes of that meeting showing <br />that !.he measure was approved by'the landowners by a vote of 255 to 15. Please Jel me <br />know if you require any additional documentation of OMID's authority to enter into the <br />proposed loan agreement. <br /> <br />Finally, I informed you that .our fInD has given OMID an opinion that it is not <br />subject to the provisions of Article X, Section 20. of the ,Colorado Constitution <br />(" Amendment .1 ") .
