This revision was certi- <br />fied technically correct by Lenny Lang, and approved by Jeff Burwell. Regula- <br />tions authorizing these employees to sign this contract have not been found. <br /> <br />Section 1 of this contract states in part that each undersioned person aorees to <br />participate in the CRSC prooram accordino to the contract terms and 7 CFR Part <br />702. Some of these terms are: <br />. OMID will provide the United States a Federal Tax 10 number for IRS use. <br /> <br />. OMID will fully comply with all contract terms and associated regulations. <br />If OMID fails to fully comply with all terms, all orant money will be re- <br />funded. <br /> <br />. The United States shall have the right to employ lawful means to enforce <br />or redress an injury by OMID, USDA, or any others. <br /> <br />. Each person sionino this contract shall fully comply with all aspects of the <br />Salinity Control Plan (SCP), includino the stated percentaoe of contribu- <br />tion. The United States will provide $200,000, and develop plans for re- <br />habilitating the four plus mile MML at an estimated cost of $1,500,000. <br />This contributed share represents about 13% of the total cost. (Later the <br />grant amount was increased to $400,000 which represents a 27% share <br />by unilateral initialling.) <br /> <br />. All parties have agree to perform the salinity control practices on the <br />lands identified for this contract. The associated regulations state eligible <br />land is that land that has been identified as a salt source area; is the <br />subject of a public Salinity Control Report; has been irrigated at least two <br />of the years between 1982 and 1986, and OMID owns the land MML <br />serves by deed or lease. <br /> <br />. OMID agree to obtain the authorities, rights, easements, or other approv- <br />als necessary to maintain and repair the SRP's. <br /> <br />Comment: One of the approvals aMID must obtain before entering into <br />this capital project agreement is landowner approval by vote according to law. <br />That approval has not been obtained. NRSC employees were first advised dur- <br />ing the spring of 1995 that OMID had not met this contract term.
