<br />necessary to matntain the system. aMID has an easement giving the District to <br />service MML. <br /> <br />Until 1993, capital improvements exceeding $20,000. were approved by a vote <br />of all landowners having one acre or more of irrigated land. Landowners having <br />less than one acre of land did not vote. For the past 15 or so years, only four or <br />five landowners served by MML have been qualified to vote under this proce- <br />dure because of this acreage rule. <br /> <br />With passage of Tabor the voting for aMID capital projects changed to a vote at <br />a general or special election by eligible votes living within the District. <br /> <br />The placing of MML in closed pipe is a capital project exceeding $20,000. aMID <br />has not conducted a landowner vote for this project under the statutory rules in <br />place prior to 1993, or the constitutional laws in place since that date. <br /> <br />The Agricultural Stabilization and Conservation (COC) committee is a group of <br />local farmers appointed to advise Farm Services Administration (FSA) about soil <br />conservation programs. <br /> <br />April 15, 1992, Bob Gobbo, a local farmer. and COC president. executed Con- <br />tract (92-233) 65-8B05-4-3207 between the United States Qovernment and <br />aMID on the behalf of the United States. <br /> <br />Mr. Gobbo is not a party competent to execute a qovernment contract. This duty <br />is left to the president of the United States. The President has the power to <br />delegate authority. to designated subordinates. According to regulations for <br />CRSC contracts, this designee is the Farm Service Administration (FSA) Deputy <br />Administrator, not a Mesa County farmer. <br /> <br />This CRSC contract shows that on June 2, 1992 a person with initials G.H. uni- <br />laterally increased the contract amount from $200,000 to $400,000, and lined <br />out OMID and pencilled in Mutual Mesa Project. <br /> <br />On July 7, 1993 a person with initials R. F. S. terminated this contract. Septem- <br />ber 14, 1994 it was reinstated by unknown parties. <br /> <br />Lenny Lang, designated SCS Technician for NRCS, located in the Grand Junc- <br />tion office, has signed the Operation & Maintain portion of this contract on behalf <br />of the United States. Regulations authorizing this employee to sign this contract <br />have not been found. <br /> <br />Also attached to this contract is Conservation Plan Agreement. Emery C. John- <br />son, District Conservationist, signed that he had certified this plan, and Kenneth <br /> <br />13 <br /> <br />/~/~/// <br /> <br />~---- <br />
