Shortly thereafter, on January j, 197J <br /> <br />the United States was served in the state court water right <br /> <br />adjudication proceedings in water Division No.7. The U.S. <br /> <br />District Court dismissed the federal suit and such action <br /> <br />/ <br /> <br />was eventually upheld by the U.S. Supreme Court in the !tin <br /> <br />case. U~~~_~~_'~1~L2~Q_Ri~QL-'~n~~L&_Qi~t.. 424 U.S. 800 <br />(1976). <br /> <br />AS a result of the decision in U~&~&-'~QLaQQ_&i~eL <br /> <br />'~n~~L&_Qi~t~__L!~Lnl, 424 U.S. 800 (197b). the United States <br /> <br />filed an application in the District Court for Water Oiv. <br /> <br />No.7 for its reserved rights and the reserved rights held <br /> <br />by the United States of America in trust for the Ute Mountain <br /> <br />Ute Indian Tribe, Southern Ute Inaian Tribe and individual <br /> <br />Indians owning trust allotments on the Southern Ute Indian <br /> <br />Reservation. (December 27, 1916 (W-1603-1b)). That appli- <br /> <br />cation claimed reserved water rights in all waters located <br /> <br />in, on. under, adjacent or otherwise appurtenant to the <br /> <br />reservation. The application was imMediately referred to <br /> <br />the referee on December 30, 1916.
