<br />. <br /> <br />~ <br /> <br />I. l~I&QQU'llQ~ <br /> <br />l~QIA~_~!lf~_~!iEi-aUl~l~E <br /> <br />The purpose of this memo is to outline the legal issues <br /> <br />likely to be faced in the Indian reserved water rights cases <br /> <br /> <br />in Division 7 and the information that will have to be assem- <br /> <br /> <br />bled to resolve those cases. A tremendous amount of research <br /> <br /> <br />needS to be done and much technical data needs to be gener- <br /> <br /> <br />ated. The important tasks to get started now are those <br /> <br />requiring a long lead time. Primarily. those tasks are <br /> <br /> <br />generation of the technical data which requires field work. <br /> <br />The collection of data in the filed is time consuming and <br /> <br /> <br />can only be performed during the summer months. The first <br /> <br />step required then is to begin discussions with the persons <br /> <br /> <br />or firms who have expertise in thOse technical disciplines <br /> <br /> <br />and preferaoly experience in reserved rights litigation. <br /> <br /> <br />The applications as filed by the United States for <br /> <br />the trioes are very vague. Thus. it is difficult now to <br /> <br />assess the extent to which certain issues will be involved. <br /> <br /> <br />This memo lists the issues most likely to be encountered <br /> <br />and suggests positions which the state may wish to adopt. <br /> <br /> <br />No attempt has been made to thoroughly develop applicable <br /> <br />law on each issue. This memo is intended as a brief survey <br /> <br /> <br />and tool for determining an approach to the Indian water <br /> <br /> <br />cases. <br />
