<br />E <br /> <br />The Districts anticipate that complete legal documents will not be available for six <br /> <br /> <br />months. The complete legal documents will serve as the detailed description of the proposed <br /> <br /> <br />steps to be undertaken within the Quantification Settlement and will be used for appropriate <br /> <br />environmental review, which the Districts hope to commence no later than April 1, 2000. . <br /> <br />II. DEFINITIONS <br /> <br />A. "As Adjusted" means adjusted by. the Inflation Index. <br /> <br />B. "Conserved Water" means water attributable to projects or programs that enable <br /> <br /> <br />the use ofless water to accomplish the same purpose or purposes of use allowed <br /> <br /> <br />under State and Federal law, <br /> <br />C. "Consumptive Use" means all diversion of water from the main stream of the <br /> <br />Colorado River, including water drawn from the main stream by underground <br /> <br />pumping, net of measured and unmeasured return flows. <br /> <br />D., "First 50 KAF Environmental Cap" means $2.1 million in 2001 dollars. <br /> <br />E. "Force majeure" means an event, not within the control of the Districts, which <br /> <br />materially and adversely affects the performance of their respective obligations <br /> <br />and duties to properly construct, operate, or maintain the means of creating <br /> <br />Conserved Water. <br /> <br />F. "Inflation Index" means (1) during the period starting January 1, 1999, and ending <br /> <br />December 31, 2024, the Producer Price Index for the Materials and Components <br /> <br />2 <br />
