2. Describe how the water activity meets these Threshold Criteria.

1. The water activity meets the eligibility requirements outlined in Part 2 of the Criteria and
Guidelines.

This project meets the eligibility requirements because:

a) It is sponsored by public governmental entities (one county and two
municipalities who either directly or indirectly provide raw and potable water
for the residents, commercial interests and agricultural interests within their
respective communities;

b) The funding request is for financial assistance in order to complete NEPA and
other permitting related tasks for an anticipated structural water project and
as such is consistent with the technical assistance goals of the grant
program.

Additionally, in 2008, one or more of the participants in the ODR group may apply
for a loan to cover final engineering and construction costs for the proposed Old
Dillon Reservoir Enlargement.

2. The water activity is consistent with Section 37-75-102 Colorado Revised Statutes. The
requirements/language from the statute is provided in Part 3 of the Criteria and Guidelines.

This project does not supersede, abrogate or otherwise impair the current water
allocation within Colorado because existing decrees allow storage of up to 281.41
acre~feet directly and by exchange, and any additional storage rights would be
pursued through a proposed Old Dillon Reservoir Second Enlargement in Colorado
water court. Therefore the existing and future storage rights in Old Dillon
Reservoir comply with applicable state laws and procedures.

3. The water activity underwent an evaluation and approval process and was approved by the Basin
Roundtable (BRT) and the application includes a description ofthe results ofthe BRTs evaluation
and approval of ilie activity. At a minimum, the description must include the level of agreement
reached by the roundtable, including any minority opinion(s) ifthere was not general agreement for
the activity. The description must also include reasons why general agreement was not reached (if it
was not), including who opposed the activity and why they opposed it. Note- If this information is
included in the letter from the roundtable chair simply reference that letter.

Since this application is only for a Basin Grant, this grant application for the Old
Dillon Reservoir Enlargement project will be reviewed by the BRT in December of
2007 and the results of that evaluation will be documented for compliance with this
criteria.
