Institutional Considerations <br />U.S. ArmyCorps Of Engineers (USACE) Regulatory Requirements <br />The proposed location for release back to the Poudre River is in an area that could potentially have <br />wetlands. A representative from Applegate Group met on -site with Terry McKee from the <br />USACE Denver Regulatory Office February 7, 2006 to discuss the possible permitting process for <br />replacing an existing temporary pump from the Reservoir to the Poudre River with a permanent <br />one designed to make River deliveries. During the site visit Terry McKee stated that most of the <br />area available for construction of a permanent pump station between the Reservoir and the Poudre <br />River is actually an upland and not a wetland. More specifically, as long as the pump station is <br />located within 30 -feet of the east Reservoir berm it would 'not impact any areas under the <br />jurisdiction of the USACE. It appears that a pump station could be located in the area described <br />and consequently, this eliminates the need for obtaining a 404 permit. We received a letter from <br />Terry McKee dated February 8, 2006 stating these same conclusions and have attached it, as stated <br />earlier in Appendix G of this report. <br />CDOT Permit for Crossing 1-25 <br />CDOT regulations for crossing highways will require the project to obtain a utility permit. <br />According to BTrenchless, which has constructed crossings of many CDOT controlled highways <br />including a current project under I -25 at the State Highway 119 interchange, obtaining this permit <br />is not difficult when the technology used is standard for the trenchless construction industry. The <br />Hobas pipe that was discussed previously has been used under CDOT 'right -of -way (ROW) <br />previously and as such it is not anticipated that the permit will be difficult to obtain. <br />City of Fort Collins <br />The conveyance system crosses the City of Fort Collins Arapahoe Bends Natural Area. The City <br />of Fort Collins will also utilize this conveyance system for the natural area and has provide; a letter <br />of support to Flatiron Companies for Flatiron Companies continued maintenance of the ditch. This <br />is attached in Appendix H. <br />Boxelder Ditch Company <br />The Boxelder Ditch Company has an agreement with Flatiron Companies to carry water in the <br />Boxelder Ditch and convey it from the Cache la Poudre River to the Timnath pit. 'This is attached <br />as Attachment I. <br />Financial Plan <br />Project Costs <br />It is anticipated that the project will cost $3,414,800. This includes purchase of the land. and the <br />water rights, construction of the reservoir infrastructure, rehabilitation of the supply infrastructure <br />and engineering services. The project cost figure is conservative as a 30% contingency is included <br />to cover any unforeseen construction costs associated with infrastructure. The cost estimate is <br />attached as figure 3. <br />
