<br />I. <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />BY-LAWS <br />BLACK DIKE PIPELINE ASSOCIATION <br /> <br />Article I: Name <br /> <br />The name of the organization shall be the Black Dike Pipeline Association, hereinaJ[ter <br />referred to as the "Pipeline Association." <br /> <br />Article II: Puroose <br /> <br />The purpose of the Pipeline Association shall be to install, maintain and operate a <br />pipeline distributing irrigation water supplied from McElmo Creek to the Pipeline <br />Association members. Installation of the pipeline will be accomplished in cooperation <br />with the Natural Resource Conservation Service (NRCS) of the US Department of <br />Agricultw'e. The NRCS will provide design/survey services and co-funding of the <br />project under the existing provisions of the Colorado River Basin Salinity Control Act. <br />If for any reason the pipeline does not get installed or the application with the NRCS is <br />rejected or expires, then the Pipeline Association by-laws will tenninate unless amended <br />under Article XI. <br /> <br />ARTICLE flI: Membershio <br /> <br />Section 1: Membership in the Pipeline Association will initially be open to all <br />landowners holding shares in Black Dike Ditch (Here and after referred to as share <br />holders) that are currently conveyed in a private ditches to properties contiguous to <br />County Road G and ] within Montezuma County, Colorado. <br /> <br />In the event that an eligible landowner declines to join the Pipeline Association during <br />the initial membership period (endingM-7bs); the shareholders shares shall not be: <br />included in the pipeline association but shall continue to be delivered to the landowner in <br />the existing ditch system. The Pipeline Association will asswne no responsibility in the <br />maintenance of the existing ditch system but will not impede the delivery of water to the <br />existing users until such times as all users elect to join the Pipeline Association. Any <br />landowner eligible for Pipeline Association membership who declines the initial <br />membership offer and who subsequently petitions for Pipeline Association membership <br />shall be admitted to full membership with rights to water delivery in the pipeline, but <br />such late petitioner shall be subject to an assessment for capital participation in the <br />pipeline, a.t an amount to be determined by the Pipeline AssOCiation memb~rship. <br /> <br />II <br />
