percolation which due to a time delayed effect causes the
majority of this water to show up in the river during the
summer time. This is the time when the UPBCC has depletions
that need to be offset with additional augmentation water.
The development of recharge ponds also provides habitat for
migratory waterfowl. The UPBCC would construct a measuring
device at the new ponds along with measuring devices at the
ends of its system. These measuring devices are required for
proper augmentation calculations as described in the UPBCC
augmentation decree and as required by the State Engineer.
The cost of this alternative is $75,000.

The Selected Project

The UPBCC plans to construct alternative #3. Features of this
alternative are as follows:

Two earthen dams (non-jurisdictional) will be constructed
across Badger Creek to form two recharge ponds.

Each dam will have a 24 inch PVC outlet pipe with a slide
gate for any potential direct releases to the creek.

Each dam will have an emergency spillway for the passing of
storm events down the creek.

The pond and dam closest to the canal will have a "morning
glory" discharge pipe. This will allow the first pond to
fill and once full water will flow into the second pond.

A current turnout from the canal will be modified to TIleaSUre
water into the recharge ponds.

Four small measuring weirs will constructed at the ends of
the UPBCC system.

Water Rights

There are 100 shareholders in the UPBCC with rights to divert 234
cfs from the South Platte River consisting of a 20 cfs right
(1868/1869), a 50 cfs right (1882), and a 164 cfs right (1888).
The official name on the decree is the UPPER PLATTE AND BEAVER
CANAL COMPANY with their water being diverted down the UPPER
PLATTE AND BEAVER CANAL.

Feasibility Study
Upper Platte and Beaver
Badger Creek Aug Project
.April 2003

7
