<br />RATIFICATION OF DOLORES WATER CONSERVANCY DISTRICT
<br />WATER ACTIVITY ENTERPRISE FUND
<br />
<br />WHEREAS, the Board of Directors of the Dolores Water Conservancy District (the
<br />"District") hereby finds, determines, and declares that it is necessary and desirable to
<br />ratify tne District's establishment in 1992, during the budget process for fiscal year 1993,
<br />of the Dolores Water Conservancy District Water Activity Enterprise F7und; and
<br />
<br />WHEREAS, S.B. 93-130 (~ 37-45.1-101 et ~ C,R.S., enacted into law on
<br />March 30, 1993, clarifies the terms and conditions under which a water conservancy
<br />district may establish a water activity enterprise fund.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED, that the Board of Directors of the District
<br />hereby ratifies the establishment of Dolores Water Conservancy District - Water Activity
<br />Enterprise, created for the purpose of pursuing and continuing water activities in
<br />connection with the Dolores Project, including water acquisition and water project facility
<br />activities, and the construction, operation, repair, and replacement of water facilities
<br />related to providing water from and through the Dolores Project; and
<br />
<br />BE IT FURTHER RESOLVED, that, pursuant to and in accordance with Article 45.1
<br />of Title 37, C.R.S., the governing body of the Dolores Water Conservancy District - Water
<br />Activity Enterprise is the Board of Directors of the Dolores Water Conservancy District;
<br />and
<br />
<br />BE IT FURTHER RESOLVED, that the Dolores Water Conservancy District Water
<br />Activity Enterprise is entitled to exercise all powers, authority, rights, and responsibilities
<br />which are exercisable by it in accordance with Article 45.1 of Title 37, C.R.S., and other
<br />applicable law; and
<br />
<br />BE IT FURTHER RESOLVED, that all assets and liabilities of the Water Activity
<br />Enterprise shall be accounted for in the Dolores Water Conservancy District - Water
<br />Enterprise Fund; and
<br />
<br />BE IT FURTHER RESOLVED, that the Board of Directors of the District ratifies the
<br />authorization of the transfer of assets, liabilities and contractual rights to the Dolores
<br />Water Conservancy District - Water Enterprise Fund in accordance with Article 45.1 of
<br />Title 37, C.R.S,; and'
<br />
<br />BE IT FURTHER RESOLVED, that, pursuant to ~ 37-45.1-106, C.R.S., revenues
<br />which are assessed and collected by the District for services in connection with providi ng
<br />water from the Dolores Project, including rates, fees, or charges for each class of service
<br />under ~ 37-45-123,124,125, and 131, C.R.S., upon receipt by the District, shall be
