Interim Guidelines for the <br />Operation of Lake Powell <br />and Lake Mead <br />Section 7. Implementation of Guidelines <br />[Content of 2001 ISG Section 7, Modeling and Data Authority, is now found at Section <br />7.A., as modified herein.] <br />A. AOP Process <br />During the Interim Period, the Secretary shall utilize the AOP process to determine <br />operations under these Guidelines concerning the coordinated operations of Lake <br />Powell and Lake Mead pursuant to Section 6 of these Guidelines, and the allocation of <br />apportioned but unused water from Lake Mead and the determinations concerning <br />whether Normal, Surplus or Shortage conditions shall apply for the delivery of water <br />from Lake Mead, pursuant to Section 1 and Section 2 of these Guidelines. <br />B. Consultation <br />The Secretary shall consult on the implementation of these Guidelines in circumstances <br />including but not limited to the following: <br />1. The Secretary shall first consult with all the Basin States before making any <br />substantive modification to these Guidelines. <br />2. Upon a request for modification of these Guidelines, or upon a request to resolve <br />any claim or controversy arising under these Guidelines or under the operations <br />of Lake Powell and Lake Mead pursuant to these Guidelines or any other <br />applicable provision of federal law, regulation, criteria, policy, rule, or <br />guideline, or regarding application of the 1944 Treaty that has the potential to <br />affect domestic management of Colorado River water, the Secretary shall invite <br />the Governors of all the Basin States, or their designated representatives, and the <br />Department of State and USIB`UC as appropriate, to consult with the Secretary <br />in an attempt to resolve such claim or controversy by mutual agreement. <br />In the event projections included in any monthly 24-Month Study indicate Lake <br />Mead elevations may approach an elevation that would trigger shortages in <br />deliveries of water from Lake Mead in the United States, the Secretary shall <br />consult with the Department of State, the USIBWC and the Basin States on <br />whether and how the United States may reduce the quantity of water allotted to <br />Mexico consistent with the 1944 Treaty.s <br />s These Guidelines are not intended to constitute an interpretation or application of the 1944 Treaty or to <br />represent current United States policy or a determination of future United States policy regarding <br />deliveries to Mexico.
