Article 2 <br />Creation and Release of ICS <br />2.1 Extraordinary Conservation ICS <br />Pursuant to procedures set forth in the ROD, the Delivery Agreement, and this Forbearance <br />Agreement, Extraordinary Conservation ICS may be created only through the following <br />activities: <br />A. Fallowing of land that currently is, historically was, and otherwise would have <br />been irrigated in the next Year. <br />B. Canal lining programs. <br />C. Desalination programs in which the desalinated water is used in lieu of <br />Mainstream water. <br />D. Extraordinary conservation programs that existed on January 1, 2006. <br />E. Demonstration Extraordinary Conservation ICS programs pursuant to a letter <br />agreement entered into between the United States Bureau of Reclamation and <br />the Contractor prior to the effective date of the ROD. <br />F. Tributary Conservation ICS created under Article 2.2 hereto and not released <br />in the Year created. <br />G. Imported ICS created under Article 2.4 hereto and not released in the Year <br />created. <br />H. Other extraordinary conservation measures, including development and <br />acquisition of anon-Colorado River System water supply used in lieu of <br />Mainstream water within the same state, as agreed upon by the Parties <br />pursuant to this Forbearance Agreement. <br />2.2 Tributary Conservation ICS <br />Pursuant to procedures set forth in the ROD, a Contractor may create Tributary Conservation <br />ICS by purchasing documented water rights on Colorado River System tributaries within the <br />8 <br />
