discussed whether Senator Allard could be helpful in contacting the Office of
Management and Budget (OMB) and if a face-to-face meeting could be arranged with
OMB. Sean Conway and Mandi McKinley agreed to look into this matter and suggested
that a meeting with OMB in August may be necessary to make our case before the
agency because of the schedule they are operating under.

Follow-on list:
. Does Omaha District have approval by the O&M managers at HQfor FY08 funds
for the Seismic Stability Report? How much?
. Couldfunds be reprogrammed to 2007 to speed the study?
. Can Chatfield move ahead of Cherry Creek on urgency justification?
. Does the Corps have a "go by" showing us a successful way to present our
results? Develop a ROD for a reallocation project? Develop water contracts and
project cooperation agreements?
. Is there a precedent for allowing storage to occur prior to completion of
mitigation activities? (Phased investment?)
. Sample contact with exhibits?
. Can we look at Prado Dam project in California as an example of money flow for
mitigation(since cash flow terms in the contract need to be identified to the
CWCB and local water users as soon as is reasonable)?
. Where do we find the documents?
. How do we obtain a "best estimate of costs" in time for legislation?

June 20 Emailfrom John Micik, USACE HQ in response to June 18 Washington, DC
meeting.
David:

Attached are examples of a water storage agreement (Word) and a ROD (Acrobat),
although the ROD is not for a water storage reallocation. I'm still trying to track one
down. It seems that for most of our reallocation actions, an environmental assessment
is adequate to meet NEP A requirements.
Also, below are two links that you may find useful. Please keep in mind, however, that
Department of the Army water storage agreements are drafted not only to reflect
Federal laws that govern water supply storage in general, but also laws that apply to
specific projects and decisions made by the Assistant Secretary of the Army (Civil
Works) under his discretionary authority.

It was a pleasure meeting with you and the others on Monday. I look forward to the
next meeting.

Regards,
John Micik
Office of Water Project Review
(202) 761-8643

Kansas City Levees EIS Page

7
