w <br />3 <br />2 <br />3 SECTION 26. 37-60-122 Colorado Revised Statutes, is amended to read: <br />4 (1) Moneys in the Colorado water conservation board construction fund shall be expended in <br />5 the following manner and under the following circumstances: <br />6 (a) Repealed. <br />7 (b) The general assembly may authorize such projects as it deems to be to the advantage of the <br />8 people of the state of Colorado and shall direct the board to proceed with said projects in the <br />9 priorities established by the general assembly under terms approved by the general assembly. The <br />10 board is authorized to make loans without general assembly approval in amounts not to exceed <br />11 ~ FIFTY million dollars. The unappropriated balance of moneys in the Colorado water <br />12 conservation board construction fund and the state severance tax trust fund perpetual base account <br />13 shall be available and continuously appropriated for this purpose. The board shall submit a written <br />14 determination of the basis for such project loans to the general assembly by January 15 of the year <br />15 following the year in which the loan was made. <br />16 <br />17 <br />18 SECTION 27. Section 15 of chapter 224, Session Laws of Colorado 2005, is amended to <br />19 read: <br />20 ~ Section 15. Oak creek ~~ CHANNELIZATION feasibility study - <br />21 appropriation <br />22 (1) In addition to any other appropriation, there is hereby appropriated, out of any moneys <br />23 in the Colorado water conservation board construction fund not otherwise appropriated, to the <br />24 Colorado water conservation board, for the fiscal year beginning July 1, 2005, .the sum of one <br />25 hundred sixty seven thousand dollars ($167,000), or so much thereof as may be necessary, for the <br />26 ~ board to participate with the city of Florence, Colorado in the Oak creek ~e~ <br />27 CHANNELIZATION feasibility study to be prepared by the United States army corps of engineers. <br />28 Other participating entities include the town of Coal Creek, the town of Rockvale, and the town of <br />29 Williamsburg. <br />30 <br />31 (2) The moneys appropriated in subsection (1) of this section shall remain available for the <br />32 designated purposes until the project is completed. <br />33 <br />34 <br />35 *SECTION 28. 37-XX-XXX Colorado Revised Statutes, is amended to read: <br />36 <br />37 Chatfield Reservoir Reallocation: the statute will authorize the CWCB to contract with the US <br />38 Army Corps to hold storage space in the reservoir; to contract with local entities who will utilize <br />39 the reservoir storage space; to loan money and receive money from entities to undertake mitigation, <br />40 operational and maintenance activities and hold such money in a $200 million fund until such time <br />41 as it is transferred to the US Army Corps of Engineers pursuant to a contract or agreement; and, to <br />42 undertake such action as is necessary, including the award of contracts and grants to public and <br />-10- <br />
