Form Revised May 2007

case, the analysis should take into consideration a reasonable range of hydrologic variation.

Rotational Land Fallowing-Water Leasing is intended to preserve irrigated agricultural
production in the Lower Arkansas Valley while allowing municipal and other users to lease water to
meet their unmet consumptive and nonconsumptive needs.

For specific information on water sources, location, yield, hydrologic variation, extent of
development and water rights please refer to HDR's Preliminary Engineering Study, Rotational Land
Fallowing- Water Leasing Program, August 2007.

7. Please provide a brief narrative of any rell-ited or relevant previous studies.

The Lower Arkansas Valley Water Conservancy District (LA VWCD) has spent in excess of
$500,000 to date of its own funds to evaluate the feasibility of a Lower Arkansas Valley Rotational Land
Fallowing- Water Leasing program, to prove the concept, and to address essential antecedent issues to the
formation of the Lower Arkansas Valley Super Ditch Company. Principle accomplishments to date
include:

a. Technical proof of concept (Jerry Kenney, Becky Mitchell, HDR Engineering; Aug. 2006).

b. Discussion and negotiation of letters of intent with potential municipal, energy, state, and other
water users/lessees (LA VWCD Chainnan John Singletary, Jay Winner; on-going).

c. Fact-finding trip to Palo Verde Irrigation District concerning their fallowing-leasing contract
with Metropolitan Water District of Southern California (2 representatives of each ditch
company, John Singletary, Jay Winner, LA VWCD staff and counsel; Feb. 2006).

d. Preliminary water engineering for water court application (HDR Engineering; Aug. 2007).

e. Economic analyses of regional water markets, alternative leasing structures, ditch company and
shareholder revenues, and regional economic impacts (George Oamek, Honey Creek Resources;
Aug. 2007).

f. Working meetings with irrigators concerning the formation of the Lower Arkansas Valley Super
Ditch Company (ditch company LA VWCD consultants, and counsel; ApI'.,
June, July 2007, on-going).

g. analysis of
2007).

f0l1115 of Super

Company (Anthony van Westrum,

Jan.

h.
