Public hearing testimony by Frank Kugel ofthe Upper Gunnison Water Conservancy District, <br />stating that they are supportive of the program and have been a funding partner since 2003. <br /> <br />FINDINGS <br /> <br />1. New daily mapping of snowpack suspension criteria by the NRCS Snow Survey Program in <br />Colorado was discussed at the public hearing and will be utilized by the CWCB, the permit holder, <br />and the project sponsors to aide in making decisions about when to suspend cloud seeding <br />operations. This will be further expanded upon in the permit. ~ 36-20-108(5)(c), C.R.S.. <br /> <br />2. The permit application review fee of$100.00 has been paid by North American Weather <br />Consultants by check Number 8837 dated July 3, 2007. ~ 36-20-112(1) (b), C.R.S. <br /> <br />3. Proof of financial responsibility was provided showing that the applicant is covered by a <br />commercial insurer with general liability in the amount of$2 million through the Buckner <br />Company of Salt Lake City, Utah. Proof of current insurance naming all project sponsors as <br />additional insured entities is a condition of the permit. ~ 36-20-112(c), CR.S. <br /> <br />4. Don Griffith, President of North American Weather Consultants of Sandy Utah submitted the <br />application for a Colorado weather modification permit and complete operational plan 45 days <br />prior to the public hearing, giving the ewCB time to review the application, operational plan, and <br />supporting documents. ~ 36-20-112(d), CR.S. <br /> <br />5. The public hearing was properly noticed as a "continuous program" in the target area counties and <br />the immediately adjacent counties for two consecutive weekends prior to the public hearing. This <br />is documented in Exhibit H. ~ 36-20-112(e), C.R.S. <br /> <br />6. The person proposed to be in charge of the project for the sponsors is Don Griffith of North <br />American Weather consultants, who provided adequate evidence of his qualifications of <br />professional education in the field of conducting weather modification operations in the State of <br />Colorado. ~ 36-20-112(g), CR.S. <br /> <br />7. The CWCB held a public hearing with the ability to be present at the CWCB office at 1313 <br />Sherman Street, Room 721, Denver, Colorado, 80203 on August 17,2007 or call in by phone. <br />The hearing was not more than one week following the completion of publication and all hearing <br />materials were posted on the CWCB website. The hearing was attended in person by: CWCB <br />staff member Joe Busto, Susan Schneider ofthe Colorado Attorney General's Office. Attending <br />via phone were: Frank Kugel of the Upper Gunnison Water Conservancy District, Jane Lee of <br />Gunnison County and Don Griffith of North American Weather Consultants who are the <br />applicants for the permit and weather modification contractors in Sandy, Utah. g 36-20-112(2), <br />C.R.S. <br /> <br />8.
