<br />FINAL DECISION <br /> <br /> <br />9. The proposed project is a commercial project and should be assessed a 2% commercial fee that <br />will be paid to the eweB. The commercial fee is 2% of the yearly contract between the pennit <br />holder and project sponsors and is used by the CWCB to maintain a permitting and monitoring <br />program and evaluate operations and their potential affects. ~ 36-20-113(1), C.R.S. <br /> <br />10. Based on the information in the proposed operational plan, testimony provided at the public <br />hearing and the information and materials reviewed in the administrative record, the proposed <br />weather modification operation: <br /> <br />A. Is conceived to provide economic benefits to the area in tenns of additional wintertime <br />recreation opportunities, enhanced stream flow, enhanced reservoir storage and enhanced <br />snowpack in the area where the operations will be conducted. ~ 36-20-112(3)(a), C.RS. <br />B. Is reasonably expected to benefit the people in the area where the operation will be <br />conducted. ~ 36-20-112(3)(b), C.RS. <br />C. Is scientifically and technically feasible. ~ 36-20-112(3)(c), C.RS. <br />D. Does not involve a high degree of risk of substantial harm to land, people, health, safety, <br />water rights or the environment.~ 36-20-112(3)(e), CRS. <br />E. Includes adequate safeguards to prevent substantial damages to land property, water rights, <br />people, health, or the environment. ~ 36-20-112(3)(t), CRS. <br />F. Will not adversely affect another weather modification project. ~ 36-20-112(3)(g), C.RS. <br />G. Is designed to minimize risk and maximize economic benefits to the residents of the area. <br />~ 36-20-112(3)(h), CRS <br /> <br />The proposed project meets all of the requirements when issuing a permit in section 36-20-112, C.R.S., it <br />is hereby determined that the permit is approved with the following conditions, which will be more fully <br />described in the permit itself. <br /> <br />1. The permit shall be limited to the purpose of augmenting snow for enhanced snowpack and runoff <br />during the time periods specified in the permit. Extensions of operational time periods can be <br />requested but will be based on snowpack suspension criteria and other conditions in the target area <br />or downstream. <br /> <br />2. Said permit shall be for the period from November 1, 2007 through April 15, 2008 with <br />conditional approval given for future operations for the five month period of November I through <br />March 31 in the years 2008,2009,2010,2011, and 2012 based on adherence to state statutes and <br />CWCB requests ofthe permit holder. The permit will expire on April 15, 2012 but may be <br />renewable by request. <br /> <br />3. The person in control ofthe project must maintain a high level of coordination and consultation <br />with federal and state agencies, local governments, and private entities listed under the tenns and <br />conditions of the permit regarding operation of the project. <br /> <br />4. Snowpack snow water equivalent suspension criteria at SNOTEL sites will be posted daily on the <br />internet by the NRCS Snow Survey Program in Colorado on a daily basis from December 15 <br />through April 15 every year. This data can be used to suspend operations in time periods when <br />snowpack exceeds levels that are within the natural variability of the local climate.
