August 6, 2007 <br />Report from the Black Canyon Quantification Committee <br />John McClow reported that on July 27th the water users finally reached an agreement with the State <br />of Colorado that provides all the protections to the water users' 2003 stipulations and at same time <br />addresses all the objections that the State had to those stipulations in a manner that was satisfactory <br />to the State. The United States has agreed to the revised stipulations, and all parties have signed <br />those revised stipulations. <br />The next step was to engage with the United States on the mediation process to address the <br />substantive issues in the case. The mediator has been selected and has toured part of the State and <br />interviewed interested parties. The first mediation session will be scheduled in the next couple of <br />months. <br />John summarized the Stipulation in 3 parts: <br />1. All existing water rights that fall between March 2, 1933 (NPS) and November 13, 1957(Aspinall) <br />would receive a subordination from the Black Canyon right. <br />2. All parties that receive subordination from the Aspinall Unit will receive subordination from the <br />Blaclc Canyon right. <br />3. Aspinall water used as augmentation supply will be subordinated by the Blaclc Canyon right. <br />1. Statewide Strategy for Non-Consumptive Needs Assessment <br />Eric Hecox and CDM presented information regarding ongoing Non-consumptive Needs <br />Assessments. Eric Hecox passed out a copy of the presentation and a copy of the 2"`~ quarterly <br />newsletter. <br />Eric Hecox asked for representatives from the GBRT for the Non-Consumptive Needs <br />Committee. Michelle Pierce asked if the members of the Needs Committee were willing to serve <br />in this capacity. Tyler Martineau and Ken Spann questioned the task and time commitment <br />required, and asked for a show of hands for interest in participation. The following GBRT <br />members agreed to sit on the Non-Consumptive Needs Committee: Steve Glazer, Tom <br />Huerkamp, Tyler Martineau, Ken Spann, Jim Hokit, Dave Kanzer, Dixie Luke, Marc Catlin and <br />Hanle Hotze. <br />Hanle Hotze suggested that the group as a whole get involved in the process. Tyler suggested <br />that the committee try to capture the list of Non-Consumptive needs then present to the GBRT <br />for prioritizing. Bill Trampe cautioned that identifying a need automatically prioritizes the need <br />and highlights it in the list of priorities. Ken Spann suggested the group not forget the Federal <br />non-consumptive hydropower rights and the importance of the rights to the Gunnison River. <br />Steve Glazer suggested that the committee reach out to the liaisons and other members of the <br />Roundtable to gather the huge quantity of data that is available to make better decisions. <br />CD's of maps were passed out to the members of the newly foi7ned Non-Consumptive Needs <br />Assessment Committee. <br />Sue Morea from CDM discussed the status of the tasks orders that were currently underway. <br />4 <br />
