<br />- , <br /> <br />B. Time of Performance. This agreement, shall become effective -' 200_ , or the <br />date approved by the State Controller or his designee and shall be in effect through March 31, 2001. <br /> <br />C. Compensation and Method of Payment. Total compensation responsibility by the Colorado Water <br />Conservation Board under this Interagency Agreement shall not exceed Five Thousand Eight Hundred <br />Thirty dollars ($5,830.00) for the time period covered by this Interagency Agreement. <br /> <br />Task 1: FLO-2D model operation and inputs; search literature for examples of integrating geomorphic <br />and hydrologic-engineering approaches for alluvial fan floodplain management; initial meetings with <br />CWCB personnel. After completion of the first task the CWCB will pay the Colorado Geologic Survey <br />$1,166.00. <br /> <br />Task 2: Conduct field assessments of all modeled alluvial fans in an area; this may involve several CGS <br />geologists at first to calibrate the main reviewer. Two field assessments would be made, one for the <br />Missionary Ridge area and one for the Coal Seam area. After completion of the second task the CWCB <br />will pay the Colorado Geologic Survey $3,498.00. <br /> <br />Task 3: To discuss CGS suitability analyses of model inputs and results for all of the alluvial fans in the <br />area. There would be one CGS letter for the Missionary Ridge area, and one letter for the Coal Seam <br />area. After completion of the second task the CWCB will pay the Colorado Geologic Survey $1,166.00. <br /> <br />D. Liabilitv. Each party agrees to be responsible and assume liability for its own wrongful or <br />negligent acts or omissions, or those of its officer, agents, or employees to the full extent required by law. <br /> <br />E. Termination. This Interagency Agreement may be terminated by any of the parties hereto upon <br />written notice delivered to the other parties at least thirty (30) days prior to intended dates of termination. <br />By such termination, no party may nullify obligations already incurred for performance or failure to <br />perform prior to the date of termination. <br /> <br />F. Changes/ Amendments/Assignment. This Interagency Agreement constitutes the entire agreement <br />between the parties. All amendments and/or changes shall be by written instrument executed by the <br />parties hereto. The parties hereto have caused this Interagency Agreement to be executed as of the date <br />set forth herein by their duly authorized representatives. The rights and responsibilities of the parties <br />under this agreement shall not be assignable without the prior written approval of the (buying agency). <br /> <br />G. Funding Availability. <br />Financial obligations of the State of Colorado payable after the current fiscal year are contingent upon <br />funds for that purpose being appropriated, budgeted and otherwise made available. <br /> <br />H. Breach of Agreement. If a dispute arises between the parties under this agreement over payment <br />for goods or services, the dispute is brought before the State Controller and he determines what payment <br />will be made between the parties involved in the dispute. <br /> <br />I. Controller's Approval. This agreement shall not be deemed valid until it shall have been approved <br />by the Controller of the State of Colorado or such assistant as he may designate. This provision is <br />applicable to any agreement involving the payment of money by the State. <br /> <br />2 <br />
