PLANNING <br /> <br />I4.J 002 <br /> <br />Proposed changes to draft agreement for Greeley Study: <br /> <br />Part D of the factual recitals <br /> <br />The following or something similar should be added to Part D: <br /> <br />Section 206 of the Flood Control Act of 1960 (74 Stat. 500; 33 U. S. C. 709a) authorizes <br />the Corps of Engineers, to compile and disseminate information on floods and flood <br />damages on behalfofthe Federal and non-Federal interests (the Flood Plain Management <br />Services Program). Section 202 of the Water Resources Development Act of 1999 <br />amends the Flood Plain Management Services Program authority to allow for voluntary <br />contributions by States, local governments, and Indian Tribes for the purposes of <br />obtaining services. <br /> <br />Paragraph 3., Time of performance. <br /> <br />Could the fixed date be changed to say, 9 months after the signing ofthe agreement. <br />Also, the completion of the study can be considered when the final study materials are <br />provided to the CWCB but coordination with the FEMA TEC and attendance at a final <br />meeting with FEMA for the FIS revision would take place an indeterminate time after the <br />submission of the report. These tasks after completion of the report are included in the <br />scope of work. <br /> <br />Paragraph 5., Disbursement of Funds. <br /> <br />We need to show that the Corps needs funding in advance of doing the work, either in a <br />lump sum or in installments. Could say- something like, " CWCB shall distribute funds .to <br />the Corps periodically as the Corps submits statements to the CWCB that set forth the <br />work to be accomplished and costs to be incurred for the time p~riod covered by the <br />statement" <br /> <br />Special provisions Paragraph 5., <br /> <br />We probably don't have the Colorado statues and would not be familiar with.
