Mr. John D. Tipton, Jr., being of lawful age and having been duly sworn upon oath,
deposes and states as foHows, to wit:

1. I reside at 1445 Northwestern Road, Longmont, Colorado 80503.

2. From 1995 through June 30, 2000, I was employed by the State of
Colorado, Division of Water Resources and served as the deputy water
commission for District NO.5.

3. During each of the summers while I was the deputy water commissioner
for District No, 5, I contacted homeowners in the St, Vrain Creek basin who
were diverting water from the 51. Vrain Creek and its tributaries.

4. I encouraged each of the homeowners who were diverting water from the
St. Vrain Creek and its tributaries to enroll in the augmentation plan of the
51. Vrain & Left Hand Water Conservancy District.

5. I contacted approximately 250 homeowners during my tenure as deputy
water commissioner,

6. Of those homeowners that resided along Middle 51. Vrain Creek, the
majority of them lived in either Raymond or Riverside.

7. Of the homeowners that I contacted in Raymond and Riverside, it was my
impression that most of them lived in old, established residences that had
been around for 50-60 years.

8. I believe that most of the homeowners in Raymond and Riverside had
been diverting water from Middle $t. Vrain Creek since before December
1987.
