<br />Dear Mr. Alvey,
<br />
<br />Concerning your application for a loan from the Construction Fund, I am pleased to inform you
<br />that the Colorado Water Conservation Board (CWCB) has granted initial approval of your request
<br />in the amount of $150,000 for the construction project. It is our understanding that these funds
<br />will be used to rehabilitate andior enlarge reservoirs owned by your Association,
<br />
<br />The CWCB also approved a loan term of 20 years at an interest rate of 4,0%, I have attached
<br />a copy of the updated Board memo concerning the LeRoux Creek Water Users Association.
<br />Please refer to page 2 of that memo and to the section "Action Taken by the CWCB, November
<br />4,1994", Your Construction loan will be considered by the State Gimeral Assembly as part of
<br />the 1995 Construction Fund bill, with passage expected in May 1995, Funds will be available
<br />about July I, 1995, provided we can negotiate a contract by that date,
<br />
<br />The Board has given their initial approval subject to several conditions:
<br />
<br />a, A Feasibility Studv must be completed, The study should include an evaluation of the
<br />alternatives the Association has considered, and state why the selected alternative was
<br />chosen, Bill Green of this office (866-3441) is working directly with your engineer,
<br />Joanne Fagan, and has sent her a letter dated November 16, 1994, a copy of which is
<br />attached, Bill can provide assistance and guidance, and will ultimately be reviewing the
<br />study,
<br />
<br />b, An approved contract must be in olace before the construction work can oroceed, Ms,
<br />Jan Illian of this office will draft the COntract in March or April of 1995, and will send
<br />you a review copy upon request. Final contract documents will be sent to you for signing
<br />after the Construction Fund bill is signed by the Governor, about June I, 1995, Please
<br />contact Jan (866-3441) after February I, 1995 to initiate the contracting procedure,
