Certification Procedures If the general pemnt is applicable to the applicant's operation, then a certification will be developed and the applicant will be . certified under this general permit. a. Request for Additional Information: The Division shall have up to thirty days after receipt of the above infonnation to request additional data andlor deny the authorization for any particular discharge. Upon receipt of additional infonnation, the Division shall have an additional thirty days to issue or deny authorization for the particular discharge. (Notification of denial shall be by letter, in cases where coverage under an alternate general pennit or an individual pennit is required, instead of coverage under this general permit.) b. Automatic Coverage: If the applicant does not receive a request for additional information or a notification of denial from the Division dated within thirty days of the receipt of the application by the Division, authorization to discharge in accordance with the conditions of this permit shall be deemed granted. c. Individual p(:nnit Required: If, after evaluation of the application (or additional information, such as the SWMP), it is foood that this general permit is not applicable to the operation, then the application will be processed as one for an individual permit. The applicant will be notified of the Division's decision to deny certification under this general permit. For an individual permit, additional information may be requested, and 180 days will be required to process the application and issue the permit. Temporary coverage under this general permit may be allowed until the individual permit goes into effect. d. General vs. Individual Permit Coverage: Any owner or operator authorized by this permit may request to be excluded from the coverage of this permit by applying for an individual CDPS permit. The owner or operator shall submit an individual application to the Division, with reasons supporting the request. 6. Permit Certifications, Applicable Sections: The individual certification prepared for each applicant will indicate whether Part I.B of the permit which must be followed by that applicant. Part I.C must be followed by all permittees unless exempted as outlined in Section ill.C of the Rationale. (In the absence of such indication from the Division, the permittee will be responsible for determining and then complying with the applicable sections in Part I.) In addition, all permittees will be required to comply with Part I, subparts A, D, E and F, and all of Part II of the permit. 7. Permit Expiration Date Authorization to discharge under this general permit shall connnence on October 1, 2002, and shall expire on September 30, 2007. The Division must evaluate and reissue this general permit once every five years, and must recertify the applicanfs authority to discharge under the general permit at such time. Therefore, any permittee desiring continued coverage under the general permit must reapply by Marc:h 31, 2007. If thepennittee's individual certification does not indicate that Part I.B of the pennit must be followed (i.e., the celtification is for stonnwater discharges only), the permittee must reapply by June 30, 2007 if they desire continued coverage under the general pennit. The Division will initiate the renewal process; however, it is ultimately the pennittee's responsibility to ensure that the renewal is submitted. The Division will determine if the applicant may continue to operate ooder the terms of the general p<:nnit. An individual permit will be required for any facility not reauthorized to discharge under the reissued general permit. For facilities wishing to terminate authorization under the new permit, provisions of Part Il.B.5.d will be applicable. 8. Inactivation of Certification The permittee may request inactivation of their certification under this permit, once the site has been fully released from their reclamation bond requirements by the Colorado Division of Minerals and Geology (CDMG). See Part 1I.B.5.d of the permit.
