Any information that you could give us in <br />advance with regard to your concerns with the water rights on Wilderness Ranch would <br />be greatly appreciated. For example, is the proposed development for individual wells? <br />Will the development's lots be 35 acre tracts or something smaller? As you may know, one of the required <br />findings that our Board n~eds to make in order to confirm an ISF appropriation is <br />whether or not the ISF can exist without material injury to water rights. I am assuming <br />that the listed rights are adjudicated, and therefore senior to the proposed ISF and as a <br />result no material injury would occur. However, in the email thread below it is stated <br />that the ISF could have devastating affects on the ability ofWinderness Ranch to grow. I <br />need to understand how you envision this happening. Are you concerned about future <br />rights that would be junior to the proposed ISF? If so, would those rights be from <br />tributary wells? Would they be exempt? Are there any specific development plans or <br />maps that could be provided of the Wilderness Ranch Community? In our investigation, <br />we need to accurately understand the concerns and attempt to address them. Would a <br />site visit be helpful? Could we meet with the developer or other Wilderness Ranch <br />community members? Any additional information that you can provide with regard to <br />the impacts to Wilderness Ranch would be appreciated. <br />Sorry I did not make that clear, but yes the list I sent you are decreed rights. I do not <br />believe I told anyone that an ISF would be devastating to the subdivision; I'm not sure <br />what the impact may be. The wells in this area are exempt as would be any future wells. <br />It seems a lot of the landowners develop springs that in most cases would never reach the <br />creek even though they are considered tributaries to Willow Creek. Those would be <br />junior to an ISF. I have no idea how many springs there are left to develop if any. <br />E-maiL.. .Jeff, Did you get a chance to discuss the proposed Willow Creek ISF <br />recommendation and any potential meeting times? If the snow is off the ground, it <br />would suggest that it may be a good idea to meet in the field with Kathy Bower, yourself <br />and any.oilier interested stakeholders. I would alsobe open to another meeting that <br />same day with the Land Board if you feel that would be helpful.
