8. FuJll and adequate notice of these proceedings and the matters adjudicated herein has been
given in the manner required by law.

9. Applicant has met aU burdens of proof and complied with all standards applicable to the
water right requested herein.

IT IS, THEREFORE, ADJUDGED AND DECREED that:

10. The provisions of paragraphs 1 - 8 above are incorporated herein.

11. It is the Ruling of the Referee that the statements in the Application arc true and thatl,385
AF of the 1,385 conditional power water right described in Paragraph 4.E.ii. is decreed abso'ute.
The Refe.r:::e further finds that Applicant has exercised reasonable di ligence in the development of the
proposed :appropriation described in Paragrapha 4;E.(iii) and this 616 cfs conditional water right is
extended.

12. It is also the Ruling of the Referee that in Case No. CA 967 power was decreed as a u:;e of
the Jackson Gulch Reservoir and the Jackson Gulch Inlet Canal. Therefore, the conditional water
right for power generation of 33 efs granted in Case No. 91CW58, described in Paragraph 5 abo'"e, is
unnecessary, and shall be considered abandoned. .

13. The Applicant shall comply with the orders (If the State or Division Engineer to install
necessary measuring devices, and shall keep records and make reports as reasonably requested by the
StClte or Division Engineer. A
