<br />. . <br /> <br />001837 <br /> <br />/ <br /> <br />Article III (c) of the 1922 Compact was prospective; it <br /> <br />provided that if the United States should recognize in Mexico any, <br /> <br /> <br />rlght to the use of the waters of the Colorado River system, <br /> <br />the waters would be supplied from waters over and above the <br /> <br />aggregate of the quantities apportioned to the Upper Basin and <br /> <br />to the Lower Basin by Article III (a) and Article III (b). Article <br /> <br /> <br />III (c) further provides that if this surplus proves insufficient, <br /> <br /> <br />then the burden of the deficiency will be equally borne by the <br /> <br /> <br />Upper Basin and the Lower Basin, and the states of the Upper <br /> <br />Division will deliver at Lee Ferry water to supply one-half of <br /> <br />the deficiency in addition to the amount required to be delivered <br /> <br />by the states of the Upper Division under Article III (d) . It is <br /> <br />interesting to note that the state of Arizona in its capacity <br /> <br /> <br />as an Upper Basin state has no obligation with respect to the <br /> <br />1944 Mexican Treaty or the Article III (d) delivery requirement. <br /> <br />The information given in the attached Table I was derived <br /> <br />from three authoritative sources. The data demonstrate that with <br /> <br />, the delivery at Lee Ferry required by Article III (d) of the Compact, <br /> <br />the water supply in the Lower Basin is more than adequate to <br /> <br />supply the 8.5 maf of beneficial consumptive use apportioned to <br /> <br />the Lower Basin hy Article III of the Compact and the 1.5 maf <br /> <br /> <br />required for delivery to Mexico in accordance with the Mexican <br /> <br /> <br />Treaty of 1944. <br /> <br />Attention is invited to the fact that according to the <br /> <br /> <br />sources cited estimates of the water supply available in the <br /> <br /> <br />Lower Basin for beneficial consumptive use and delivery to Mexico <br /> <br />vary from 10.68'0 maf annually to 10.125 maf annually.
