The prin- <br /> <br />,..- <br /> <br />cipal issues addressed were bypasses at' the San Juan-Chama Project <br /> <br />diversion works for the preservation of fish and aquatic life and <br /> <br />decreed water rights, and the sluicing o{ silt accumulations from <br /> <br />the project diversion works. <br /> <br />By letter to Senator Church dated July II, 1974 and by the <br /> <br />July 8, 1974 resolution of the Jicarilla Apache Tribal Council that <br /> <br />accompanied that letter, the President of the Jicarilla Tribe <br /> <br />addressed the same two issues addressed in the complaint in Schutz <br /> <br />vs Stamm and further, claimed rights under the Winters Doctrine to <br /> <br />the waters being diverted from Navajo Rive~ by the San Juan-Chama <br /> <br />Project. The letter and resolution also expressed the Tribe's <br /> <br />opposition to the temporary use of water for a minimum recreation <br /> <br />pool at Elephant Butte Reservoir or for uses such as coal gasifica- <br /> <br />tion plants. <br /> <br />On March 17, 1975 the Jicarilla Tribe filed a Motion to <br /> <br />Intervene and Complaint in Intervention in Schutz vs Stamm joining <br /> <br />in the original plaintiffs complaint against the operation of the <br /> <br />San Juan-Chama Project Rnd alleging impairment of water rights in <br /> <br />the Navajo River claimed by the Tribe. The State of New Mexico had <br /> <br />already on March 13, 1975 filed a suit in State District Court seek- <br /> <br />ing an adjudication of all water rights, including federal claims, <br /> <br />in the San Juan River system in New Mexico pursuant to Section <br /> <br />75-4-4 NMSA 1953. In 1948 all of the then existing nonfederal rights, <br /> <br />~.~ none of the federal rights, were adjudicated in a State District <br /> <br />Court decree. <br /> <br />By letter dated November 12, 1974 Senator Henry M.
