STATE OF COLORADO

OFFICE OF INTERBASIN COMPACT NEGOTIATIONS

to correct the violation is to hold an open meeting and, if applicable, an
open meeting that is properly noticed. No subsequent approval or mbber-
stamping of an improperly held meeting can validate the public body's
actions taken during the improper meeting.

b. If a public body violates the OML, upon the application by any Colorado
citizen, any state court in Colorado may issue an injunction to enforce the
OML. A cOUli finding a violation must award the prevailing citizen
reasonable attorneys fees and costs. If the court finds no violation and
finds that the action was frivolous, it must award reasonable attorneys fees
and costs to the prevailing party.

G. Conclusion

a. The Office ofInterbasin Compact Negotiations encourages each member
of the IBCC to review the Open Meetings Law and keep a copy of this
summary for future reference. This summary represents the best judgment
and guidance by the Office ofInterbasin Compact Negotiations with
respect to the issues addressed, but does not cover all issues that may arise
and should not be viewed as a controlling legal document, or a
recommended code of conduct. Ultimately, each member must rely upon
his or her best judgment in making decisions that relate to his or her
service on the IBCC, and the Office ofInterbasin Compact Negotiations
encourages any member who is uncertain about how to respond in a
particular situation to seek the advice of the Office ofInterbasin Compact
Negotiations.

1313 Shennan Street.
