No subsequent approval or mbber- <br />stamping of an improperly held meeting can validate the public body's <br />actions taken during the improper meeting. <br /> <br />b. If a public body violates the OML, upon the application by any Colorado <br />citizen, any state court in Colorado may issue an injunction to enforce the <br />OML. A cOUli finding a violation must award the prevailing citizen <br />reasonable attorneys fees and costs. If the court finds no violation and <br />finds that the action was frivolous, it must award reasonable attorneys fees <br />and costs to the prevailing party. <br /> <br />G. Conclusion <br /> <br />a. The Office ofInterbasin Compact Negotiations encourages each member <br />of the IBCC to review the Open Meetings Law and keep a copy of this <br />summary for future reference. This summary represents the best judgment <br />and guidance by the Office ofInterbasin Compact Negotiations with <br />respect to the issues addressed, but does not cover all issues that may arise <br />and should not be viewed as a controlling legal document, or a <br />recommended code of conduct.
