<br />STATE OF COLORADO <br /> <br />OFFICE OF INTERBASIN COMPACT NEGOTIATIONS <br /> <br />other means of communication. A state public body meeting is covered by <br />the OML and is required to be an open public meeting if: 1) two or more <br />members of the body meet to discuss public business or, 2) hold a meeting <br />at which formal action is taken <br /> <br />b. Even if a meeting is required to be open, no public notice of the meeting is <br />required unless the meeting satisfies any of the following criteria: 1) any <br />proposed policy, position, resolution, nile or regulation will be adopted; 2) <br />any formal action will be taken; or 3) the attendance or expected <br />attendance equals of exceeds a majority or quorum of the body. <br /> <br />c. Electronic mail used by elected officials to discuss public business among <br />themselves is a "meeting" and must comply with the OML's "open <br />meeting" mandate. <br /> <br />d. The OML does not apply to chance meetings or social gatherings where <br />discussion of public business is not the central purpose. <br /> <br />e. As a general nile, any meeting involving 2 or more IBCC members, <br />whether it occurs in a hallway, office, committee room, or through an <br />electronic medium, is required to be open to the public if the meeting <br />involves the discussion of public business or taking of formal action. Even <br />though the meeting is required to be open, the meeting is not required to <br />be noticed unless such an open meeting involves policy adoption, formal <br />action, or a quonlll1. <br /> <br />D. Requirements of the OML <br /> <br />a. Notice <br /> <br />1. Generally, no public notice of an informal open meeting is <br />required. "Full and timely notice to the public" always is required, <br />if any open meeting involves: 1) the adoption of any proposed <br />policy, position, resolution, nile, or regulation; 2) the taking of any <br />formal action; or 3) attendance or expected attendance of a <br />majority or quonlll1 of the body. At the very minimum, "full and <br />timely notice to the public" requires that notice be posted within a <br />reasonable time prior to the meeting in an area that is open to <br />public view. <br /> <br />11.
