2-28 House Committee amended to appropriations

Rep. Pelll~v:

Correct, and so that will probably be, Madame Chair, that will
probably be the easiest way for members to follow along 'cause I'm
just gonna go through the unedited, unrevised draft of2/28/05,
where all of the proposed changes are incorporated in a single
place.

Madame Chair:

Good. Thank.

Rep. PelllY

So, with that, let's begin on Page 3 at Line 12, you'll see that we
added some new language that broadened some concepts in the
original bill to make clear that nothing in this bill would modify or
otherwise alter, either prior existing valid water rights, the prior
appropriations system in the State of Colorado, or the MOU s, the
contracts and agreements that have shaped our water policy over
the course of the last 150 years. And so, this is all very clear
disclaimer language to make sure that this legislation doesn't upend
or upset sort of the balance that we've established in this state.

The other thing that's impOliant that it does is it makes clear that
this is a voluntary process. We're hoping that this process works
and we think it will work, and therefore, people will want to use
this process in order to get things done. But the process is not
itself a mandatory process. If you wanted to build a project or
embark on some other activity. But again, we hope, we think that
people will cling to this process and want to use this process
because fi.Jl1damentally it works. And we clarified that issue,
which was dealt with in the initial draft but just added some greater
depth on that.

Madame Chair: Excuse me, Representative Penry, you're talking about LO 13 right?

Rep. PelllY Yeah

Madame Chair: Okay. Is everybody with us?

Rep. Gallegos: I don't have a copy.

Female #1: I don't have it.

Rep. PelllY I just handed you a copy, I think the copy I just handed you.

Madame Chair: Okay, 2/28 unedited, unrevised draft, Page 3, does that help,
Representative Gallegos?

Rep. Gallegos: Okay

www.escriptionist.com Page 3 of 22
