3. PERFORMANCE OF THE WORK

.

A. Contractor's Personnel

.

CONTRACTOR shall employ competent, technically qualified personnel in
sufficient number to complete the work herein in a timely manner. The employees
are expected to behave in a courteous manner to the generaL public while working on
any DISTRICT job site. The time of assignment of all personnel shall be the sole
responsibility of CONTRACTOR. Without prejudice to anything in this section,
CONTRACTOR shall promptly report to DISTRICT in writing or by phone
(confirmed in writing within five working days) to DISTRICT's
REPRESENTATIVE the occurrence of any event or condition that might delay or
prevent timely or proper completion of the work hereunder and shall indicate the
action being taken to alleviate the situation. CONTRACTOR shall:

Employ and maintain a qualified supervisor or superintendent who shall be
identified in writing by CONTRACTOR to DISTRICT who may be required
by the DISTRICT by a CHANGE ORDER to be on the job site full time. The
supervisor shall:

a.

Have the authority to act on behalf of CONTRACTOR and all
communications by DISTRICT given to supervisor shall be binding on
CONTRACTOR;

.

b.

Have full authority to represent CONTRACTOR in dealings with
DISTRICT and be in charge of CONTRACTOR's work under this
Agreement;

.

c. Be responsible for the professional conduct of CONTRACTOR's field
organization, with the authority and responsibility for taking action with
respect thereto;

.

d.

Take all reasonable measures to assure that the general conduct of
CONTRACTOR's field staff does not violate any governmenta1law, rule
or regulation.

2.

Remove immediately from the job site any personnel found to behave in a rude
or discourteous manner toward the general public or found to be under the
influence of drugs or alcohol while on or near the job site.

B.

Inspection and Testing

.

DISTRICT inspection and testing will be performed by DISTRICT personnel or by a
consulting firm under a separate contract to DISTRICT. CONTRACTOR will
consider such an inspector to be an agent of the DISTRICT with the power to review
