<br />. <br /> <br />3. PERFORMANCE OF THE WORK <br /> <br />. <br /> <br />A. Contractor's Personnel <br /> <br />. <br /> <br />CONTRACTOR shall employ competent, technically qualified personnel in <br />sufficient number to complete the work herein in a timely manner. The employees <br />are expected to behave in a courteous manner to the generaL public while working on <br />any DISTRICT job site. The time of assignment of all personnel shall be the sole <br />responsibility of CONTRACTOR. Without prejudice to anything in this section, <br />CONTRACTOR shall promptly report to DISTRICT in writing or by phone <br />(confirmed in writing within five working days) to DISTRICT's <br />REPRESENTATIVE the occurrence of any event or condition that might delay or <br />prevent timely or proper completion of the work hereunder and shall indicate the <br />action being taken to alleviate the situation. CONTRACTOR shall: <br /> <br />. <br /> <br />1. <br /> <br />Employ and maintain a qualified supervisor or superintendent who shall be <br />identified in writing by CONTRACTOR to DISTRICT who may be required <br />by the DISTRICT by a CHANGE ORDER to be on the job site full time. The <br />supervisor shall: <br /> <br />. <br /> <br />a. <br /> <br />Have the authority to act on behalf of CONTRACTOR and all <br />communications by DISTRICT given to supervisor shall be binding on <br />CONTRACTOR; <br /> <br />. <br /> <br />b. <br /> <br />Have full authority to represent CONTRACTOR in dealings with <br />DISTRICT and be in charge of CONTRACTOR's work under this <br />Agreement; <br /> <br />. <br /> <br />c. Be responsible for the professional conduct of CONTRACTOR's field <br />organization, with the authority and responsibility for taking action with <br />respect thereto; <br /> <br />. <br /> <br />d. <br /> <br />Take all reasonable measures to assure that the general conduct of <br />CONTRACTOR's field staff does not violate any governmenta1law, rule <br />or regulation. <br /> <br />. <br /> <br />2. <br /> <br />Remove immediately from the job site any personnel found to behave in a rude <br />or discourteous manner toward the general public or found to be under the <br />influence of drugs or alcohol while on or near the job site. <br /> <br />B. <br /> <br />Inspection and Testing <br /> <br />. <br /> <br />DISTRICT inspection and testing will be performed by DISTRICT personnel or by a <br />consulting firm under a separate contract to DISTRICT. CONTRACTOR will <br />consider such an inspector to be an agent of the DISTRICT with the power to review <br /> <br />. <br /> <br />14 <br />
