Jaeger: If you look at this for the whole river, and see that each farmer could
release 20% of his water going back to the river, then that water goes into a
COOP and that company can lease it back.

Joe Frank: this is actually taking saved water and releasing it; not drying up
the ground; this different from AK, as 25% of the ditch is being dried-up and
the water goes into a "super-ditch" company; rotational process.

Jaeger: Studies are focused on how to lease 20,000 acft of water; how is it
done technically but also what will the results be.

Jerke: Question to Mike Shimmin: As per leased water, salvaged water and
CO statute:
Shimmin: careful with terminology: this is not "salvaged water"; "saved
water" is not a term of art in water law; concept of change of water right is
very flexible; for anyone to say that this would not be allowed under water
law, not tme; Change of water right means that water right can be changed
without injuring anyone else; nothing that has been discussed, seems to be
illegal.

Jerke: Do we have the authority to spend money to study something that is or
is not allowable under CO water law.

Jaeger team member: My role is to make sure that we are doing this in a way
that complies with CO water law. Looking to operate within existing water
law.

Walter Knudsen: Is this an expansion of use?

Jaeger: No. Study is to show that we are using less water on same crops on
the same acreage.

Don Ament: Please explain process of linear sprinkler.

Jaeger team member: Linear sprinkler: they will have flow meters in every 60'
x 200' section so that they can vary the amount of water being delivered from
the linear sprinkler; 40 acres;
Crops: corn, winter wheat, oil seed, canolas, sun flowers, soy beans.. .looking
at crops that are typical high water users and then others that are not typical.

Fred Walker: From farmer perspective: this is wrong way to engage
agriculture to urban needs.. .how to reduce water. I personally have
commitments to Western Sugar, Coors Barley and corn contracts; so we are
more of an industrial partner; therefore, we do not have the flexibility and
availability of excess water that we can commit to a municipality unless the
return is higher; as per the return... focus needs to be what is the value of the

5
