Doug — understood that met with R io G rande County and EPA and could not come up
w ith an agreement?

Jim — that was with Arcadis, they wanted to do a consent decree — i .e.: t ake over whole
site — with this approach - Pilot Project -- they have agreed technically approach — now
giving them what they asked for and prove the savings – made a formal proposal a year
ago and it’s been accepted technically -- by Arcadis and Green World Science

Joe — explained more about the political process and who’s in favor of it — if state money
at 10% is there, have solid congressional support to go for funding and get f uture
congressional funding — for pilot project -

Discussion of issues , logistics, funding, # of trucks, if new plan works, no new treatment
plant would be needed — benefit is that you treat the source area so it’s treated before it
runs off so it doesn’t matt er how big the run off is

- For Pilot Project -- need 10% matching state funds of $90,000 – have $15,000
alrea dy — State is not willing to put money towards innovative approaches

See www.alexcoresource.com for www.aaee.com and EPS Region 8 - Gilt Edge site

Next steps —

Mike G. - would need commitment from EPA and State to go forward

Doug suggests that this might fit better with State’s Water and Power Development
Authority than with CWCB —

Ray -- generally CWCB deals with r aw water – water quantity than water quality — this is
a little different — not sure how this would extend to mine site clean up

Mike G - does this fit the criteria for RT? If want to pursue, need to investigate
applicability and fit

ANNOU N CEM E N TS —

Seminar: March 29, 2007 - Enhancing your Understanding of Water Management —
CSU Workshop

Ray — word is out among farmers that “we’ve got ple nty of water” and need to put on
end guns and cor ners to somehow benefit under Subdistrict plan — showing high water
use so as t o justify high wate r use that can later be cut — However, our snowpack is
currently at 85% -- now record high temps — Closed Basin is 1 mill ion acre feet in the
hole — not a part of the Subdistrict plan that has any level of base water use
contemplated — There is NO B ENEFIT to an individual to over - pump for future gain of
a ny sort! Message: Use restraint — don’t plant crops you may not be able to finish out
Page 7 of 8 RGB RT Minutes

March 13, 2007
