In addition, the Board directbd Staff to continue to try to negotiate with <br />Jackson County with the intent of providing settlement language which will ensure that any <br />instream flow appropriations on the subject streams will not deprive the water users of the North <br />Platte River and its tributaries of the water guaranteed to them by the Nebraska v. Wyoming <br />equitable apportionment Supreme Court Decree. : <br /> <br />I <br />Since the January meeting, staff has approached theiJackson County Water Conservancy District <br />through their Attorney, Kent Holsinger, on two different occasions in order to try and set up a <br />meeting to begin negotiations. In e-mail correspon'dence dated April 11, 2007, Kent Holsinger <br />I <br />indicated that his client had asked him not to perform further work on the matter at this point as <br />they are assessing their options and are therefore ndt yet ready to discuss specific language with <br />the CWCB. Staff will continue to try to contact Jaclkson County to move negotiations forward. <br />It should be noted that the Jackson County WCD has also filed for participant status on the <br />unrelated, yet contested Division 3, Alder Creek, ins,tream flow recommendation. <br />I <br />1 <br /> <br />.. <br /> <br />Stafr Recommendation <br /> <br />Staff recommends that the Board designate a Hearing Officer Jnd set hearing dates for <br />Badger Creek and Alder Creek. <br /> <br />i <br />I <br />I <br />I <br />I <br />! <br />Flood Protection.
