Water available to the CWCB for instream flow use under the Agreement was <br />used to maintain the CWCB's instream flow ~ater rights in various reaches of Boulder <br />Creek from November 2005 through mid-Mar~h 2006, in the later part of April 2006, and <br />from the end of July through October 2006. ~e CWCB used approximately 1,115 acre- <br />feet of donated water from the City for instreaPt flow use. Additionally, the City <br />exercised its right to lease water generated by Its operations under the Agreement to <br />I <br />users downstream of the CWCB's instream flo~ reach. <br />I <br />Jackson County ISF recommendation neg,otiations: At its January 24,2007 meeting <br />the Board tabled the Jackson County instream flow recommendations on Indian Creek, <br />North Fork North Platte River, and South For~ Big Creek for a period of one year. In <br />addition, the Board directed Staff to continue tb try to negotiate with Jackson County <br />with the intent of providing settlement langua~e which will ensure that any instream <br />flow appropriations on the subject streams will not deprive the water users of the North <br />Platte River and its tributaries of the water guaranteed to them by the Nebraska v. <br />Wyoming equitable apportionment Supreme Gourt Decree. <br />I <br />I <br />i <br />Since the January meeting, staff has approached the Jackson County Water Conservancy <br />District through their Attorney, Kent HolsingeJ, on two different occasions in order to <br />try and set up a meeting to begin negotiations. iIn e-mail correspondence dated April 11, <br />2007, Kent Holsinger indicated that his client lYad asked him not to perform further <br />work on the matter at this point as they are ass~ssing their options and are therefore not <br />yet ready to discuss specific language with the CWCB. Staff will continue to try to <br />contact Jackson County to move negotiations f~rward. It should be noted that the <br />Jackson County WCD has also filed for participfmt status on the unrelated, yet contested <br />Division 3, Alder Creek, instream flow recommendation. <br />I <br />! <br /> <br />I <br />I <br />Attachments <br /> <br />1.
