I believe you letter accurately describes our mutual understanding of
the requirements with a few minor revisions. The additional language is emphasized as follows:

3. Model will install a continuous stage-recording device to measure the surface
elevation of the Black Hills Reservoir. In addition, Model will conduct a survey of
the contour lines ofthe reservoir with a vertical interval of no more than one foot, and
prepare tables relating estimated capacity and surface area to water surface elevation
in O.OI-foot increments from the lowest point in the reservoir to at least the bottom of
the spillway. This information will be submitted to your office.

4. Model will construct a channel section (to be hydraulically rated) in the Model Ditch
below the outlet from the Black Hills Reservoir capable of measuring the Inaximum
design outlet capacity of250 cfs, and install a continuous recording device to measure
the approximate water surface elevation in the rated channel section and install a
readily observable staff e:aue:e. In addition, Model will provide a rating table
relating water elevation in the channel section to discharge.

5. Model will construct aft additional waste way capacity from the Model Ditch below
the Black Hills Reservoir, either at the loeation of the Furness Arroyo or Waste Way
#l,so that there is a total combined waste way capacity at the current location of
Waste Way # 1 and the Furness Arroyo of 110 cfs. In addition, if Model enlarges
Waste 'Way 1fl, Model will increase the capacity of the waste channel from Waste
Way #1 to Black Hills Arroyo to the capacity of the enlarged waste way, which shall
be desie:ned to pass at least 70 crs. Finally, Model will equip each waste way with a
