D <br />ANIEL OMENICO <br />Solicitor General <br /> <br />June 19, 2007 <br />M E M O R A N D U M <br />TO: <br /> Interbasin Compact Committee <br /> <br />FROM: <br /> James Eklund, Assistant Attorney General <br />RE: <br /> Colorado River Subunit and Law of the River <br /> <br />The Colorado River Subunit was created within the Color ado Office of the Attorney <br />General in the Spring of 2006 for purposes of: (1) representing the state of Colorado in <br />current Colorado River litigation; (2) providing Colorado with legal advice and counsel with <br />respect to current Colorado River negotiations ; (3) preparing Colorado for possible interstate <br />compact litigation regarding the Colorado River; and ( 4 ) assisting the Colorado State <br />Engineer with respect to intrastate water administration issues. <br /> <br />L <br />ITIGATION <br /> <br />The Colorado River Subunit has represented Colorado in the following cases: <br /> <br /> <br />Plaintiff challenged Reclamation's operation of Glen Canyon Dam on environmental <br />grounds in Center for Biological Diversity v. Bureau of Reclamation , Case No. 3:06 - CV - <br />00494 (D. Ariz. 2006). Colorado participated in achie ving a favorable settlement. <br /> <br />Plaintiffs attempted to halt the lining of the All - American Canal in Consejos de <br />th <br />Desarrollo Economico de Mexicali v. Norton , 482 F.3d 1157 (9 Cir. 2007). Colorado <br />authored an amici curiae brief in this case arguing that the water claimed by the Plaintiffs <br />was apportioned among the Seven Basin States. The Ninth Circuit affirmed the lower <br />court's decision dismissing Plaintiffs' claims. <br /> 1 <br />
