I greatly appreciate you spirit of cooperation and your <br />willingness to answer my many questions. I wish to be a responsible landowner and I <br />also have a deep desire to preserve the natural environment and protect the water courses <br />in Colorado. <br />However, I have some serious concerns about this proposed filing that I would <br />like to bring before the CWCB for their consideration. I understand there is an ancient <br />diversion point one-half mile above my property line that would be closed by this filing. <br />I am willing to concede the closure of future use of that diversion point. However, my <br />understanding is that the proposed lower terminus of this reach would extend the reach <br />into my property along Alder Creek. There is a historical diversion point at the western <br />property line that the previous owner used and that I may need to use in the future. I <br />would object to that diversion point being lost for my future use by this filing. I also may <br />want to place wells near that western property line for my future home and would object <br />ifthis filing prohibited my freedom to do so. In addition, there is active beaver pond/dam <br />building in Alder Creek near the western property line and the reach of this filing as <br />proposed would span that section of Alder Creek. I would not want this filing to interfere <br />with this natural water storage process as I have plans to stock these natural ponds with <br />fish in the future. Here, I would hope, the Board would agree that our mutual desire to <br />preserve the natural habitat places us in c'ooperation rather than confrontation. My <br />request is that the Board redefine the lower terminus of this in stream reach to end at the <br />current western property line where BLM joins my private property. I believe this will <br />still secure the in stream flow right sought by the CWCB, close the upper ancient <br />diversion point and protect my water and property rights. <br /> <br />Thank you for your consideration and I look forward to <br />working with the Board to preserve Alder Creek and the beautiful environment along its' <br />course. <br /> <br />Sincerely, <br /> <br />Timothy McLeod <br />
