<br />. <br /> <br />. <br /> <br />. <br /> <br />CWCB Base Agreement version 5 <br />DRAFT 3/01/07 <br /> <br />AGREEMENT AMONG THE SIX AGENCY COMMITTEE, <br />THE CENTRAL ARIZONA WATER CONSERVATION DISTRICT, <br />THE SOUTHERN NEVADA WATER AUTHORITY AND THE <br />COLORADO WATER CONSERVATION BOARD TO PROVIDE FUNDS FOR <br />WEATHER MODIFICATION PROGRAMS IN THE STATE OF COLORADO <br /> <br />This Agreement between: (1) the (California) Six Agency Committee, the Central Arizona Water <br />Conservation District, and the Southern Nevada Water Authority (the "Lower Basin Parties"); <br />and (2) the Colorado Water Conservation Board, facilitates weather modification programs <br />within the State of Colorado (Parties). <br /> <br />In an effort to increase the supply of water available for use within the entire Colorado River <br />System, the Parties seek to extend, expand, modify, or create new weather modification <br />programs in Colorado. The weather modification activities to be implemented through this <br />Agreement consist of cloud seeding appropriate orographic storms, evaluations, and other related <br />activities ("Activities") to increase precipitation in the various program areas identified in this <br />Agreement or any amendments thereto <br /> <br />This Agreement consists of a base Agreement and any amendments in the form of Exhibits and <br />incorporated by reference which describe weather modification activities and funding levels for a <br />given Water Year (WY). <br /> <br />RECITALS <br /> <br />A. Parties <br /> <br />1. The Colorado River Board ("CRB") of California was created in 1937 by the California <br />Legislature in recognition of the vital nature ofthe Colorado River water and power resources to <br />the general well being of the state, its agencies, and its citizens. As California Water Code <br />Section 12550 permits monies to be contributed in support of the state's funding of the Colorado <br />River Board, the Six Agency Committee was created in 1950 to provide such support. <br /> <br />1.1. The Six Agency Committee is a Joint Powers Authority composed of six Southern <br />California public agencies with Colorado River water and power interests: Coachella Valley <br />Water District, Imperial Irrigation District, Los Angeles Department of Water and Power, Palo <br />Verde Irrigation District, San Diego County Water Authority and The Metropolitan Water <br />District of Southern California. The Six Agency Committee administers funds contributed by <br />the represented agencies, which currently accounts for 100 percent of the CRB's budget. The <br />purpose of the Committee is to administer funds contributed by the represented agencies for <br />purposes that will protect and advance their rights and interests in the Colorado River System. <br />
