Also, up to an <br />additional 300 cfs of tributary inflow to IS-Mile Reach would be protected by the <br />CWCB's flow accretion right. No flows in the IS-Mile Reach are currently protected by <br />instream flow decrees outside the July-August-September time frame. However, the <br />CWCB filed in 1995 for year round instream flow rights for the IS-Mile Reach as shown <br />in 'Background Block 8'." We recommend moving Background Block 8 up to this point. <br />Page 26, Compliance with Clean Water Act, Impacts: Depending on when HUP <br />releases of saved water are made, there may be some impacts to water quality during the <br />low flow winter months. This should at least be mentioned as a possibility. <br />Page 28, Selenium Contamination: Need to note that lower winter flows may have <br />possible impacts here as well. <br />Page 37, Coordination with Other Recovery Program Activities, Indicator: Suggest <br />rewording as follows, "Progress in providing water to the IS-Mile Reach in a manner that <br />satisfies the U.S. Fish and Wildlife Service flow recommendations." It seems to us that <br />this is the goal rather than satisfaction of the CWCB's instream flows. The CWCB's <br />rights are to provide legal protection for these recommendations to the extent the CWCB <br />has determined water is both physically and legally available. <br />Page 37, Coordination with Other Recovery Program Activities, Existing <br />Conditions: Could expand a little on the Ruedi contracts, while we have actually been <br />delivering Ruedi water since 1988, we have only done the additional 10,000 AF contract <br />since 1991. Also, Coordinated Reservoir Operations were accomplished during 1997 for <br />the first time. The goal of Coordinated Reservoir Operations is to bypass inflows to the <br />major reservoirs upstream of the IS-Mile Reach during the peak of spring runoff to <br />increase the peak and help do additional channel maintenance work to improve habitat. <br />As noted, long-term agreements to deliver water from Ruedi and Wolford specifically for <br />endangered fish purposes are under development. <br />Page 37, Coordination with Other Recovery Program Activities, Existing <br />Conditions: Delete the paragraph on state water rights for the IS-Mile Reach if <br />previously discussed. <br />Page 37, Coordination with Other Recovery Program Activities, Existing <br />Conditions, Last Paragraph: Change the word, "additional" to "the remaining HUP". <br />We are not creating any additional conserved water, just trying to deliver the surplus that <br />was created as a result of the improvements. <br />Page 37, Background Block 8: Revise as follows, "In 1995, the Colorado Water <br />Conservation Board made two year-round instream flow f1lings as described below." <br /> <br />Base Flow Water Right - This right seeks to protect a certain defined level-of base flow in <br />order to limit future impacts to the endangered fish and their habitat during low.- flow'" <br /> <br />,... -...... ~, <br /> <br />.. , <br />
