Office <br />402 Rood Avenue, Room 142 <br />Grand Junction, CO 81501-2563 <br /> <br />Subject: <br /> <br />Smith Ditch Project <br /> <br />Dear Grady: <br /> <br />You may recall in connection with the Cary Ditch Project west of Hayden on the <br />Yampa River, we asked you whether or not a 404 Permit would be required for the <br />Project. Your response dated 30 August 1996 stated the excavation and discharges <br />associated are exempt from the Corps of Engineers regulation under Section 404 the <br />Clean Water Act. <br /> <br />The District is now working on a similar project on Elkhead Creek just Northeast of Craig <br />where the Creek has actually bypassed the diversion structure. The result is the <br />ranchers have not been able to irrigate their hay meadows for the last 2 years. The <br />total cost of the project will be in the neighborhood of $150,000 of which the District will <br />fund a major portion. <br /> <br />Irrigators are applying to the Colorado Water Conservation Board for a $50,000 long <br />term loan. We need to provide to CWCB a letter similar to the one referred to above <br />stating work related to the proposed irrigation structure in Elkhead Creek will also be <br />exempt from 404 which we assume would be the case. Enclosed herewith is a <br />description of the Project together with its location.
