PE. <br />Director. eWeB <br /> <br />Mr. Mark Hermundstad <br />Williams, Turner & Holmes, P.C <br />200 N 6th Street <br />Grand Junction, CO 81501 <br /> <br />Re: Ute Water - Plateau Creek Pipeline Project <br /> <br />Dear Mark: <br /> <br />In regard to your recent inquiry regarding the requirements ofC.R.S. 37-60-122.2 (1) (b) <br />with respect to the Ute Water Conservancy District's Plateau Creek Pipeline Project, it is <br />our opinion that it is not necessary for Ute Water to submit a mitigation proposal to the <br />Colorado Water Conservation Board (CWCB), the Colorado Wildlife Commission and <br />the Colorado Division of Wildlife pursuant to this section. Our understanding of the <br />legislative intent here is that the mitigation proposal requirement applies only in those <br />cases where the project sponsor is applying for mitigation funding from the Fish and <br />Wildlife Resources Account of the CWCB Construction Fund as provided in the statute. <br /> <br />Please let me know if you have any questions or if we can be of any further assistance. <br /> <br />Sincerely, <br /> <br />/?~ <br /> <br />William E.
